# The A46 Newark Bypass Development Consent Order 2025, Paragraph 29: Arbitration

Extent: E+W

Save for difference or disputes arising under paragraphs 21(2) and (4) (removal of apparatus) and 23(11) (retained apparatus: protection of Cadent) any difference or dispute arising between the undertaker and Cadent under this Part of this Schedule must, unless otherwise agreed in writing between the undertaker and Cadent, be determined by arbitration in accordance with article 56 (arbitration).
