Section 29 (Recovery of insurance premiums by way of costs) shall not apply, as regards a party to proceedings, to:

(a)

any proceedings in relation to which that party took out an insurance policy of the sort referred to in section 29 before 1st April 2000; or

(b)

any proceedings arising out of the same cause of action as any proceedings to which sub-paragraph (a) refers.
