  "heading": "Regulations about deciding whether an individual development plan is necessary",
  "text": "(1) Regulations under this section apply to the following provisions and decisions made under them—\n(a) section 14(1)(c)(ii);\n(b) section 31(6)(b);\n(c) section 40(2)(b).\n(2) Regulations may—\n(a) specify factors to be taken into account in assessing whether it is necessary to prepare or maintain a plan;\n(b) specify circumstances in which it is, or is not, necessary to prepare or maintain a plan;\n(c) provide for what are, and what are not, to be considered reasonable needs for education or training (whether in specifying factors, specifying circumstances or otherwise);\n(d) make further provision about the definition of “education or training”;\n(e) make provision about the process for making decisions.",
