# The Adoptions with a Foreign Element Regulations 2005, Regulation 39: Recommendation of adoption panel

Where an adoption panel make a recommendation in accordance with regulation 18(1) of the Agencies Regulations or corresponding Welsh provision it must consider and take into account the Article 15 Report, if available, and the observations thereon together with the information passed to it as a consequence of regulation 38.
