# The Aggregates Levy (General) Regulations 2002, Regulation 38


(1) A person who fails to comply with a requirement imposed on him by or under any of the following provisions of these Regulations shall be liable to a penalty of £250 for each such failure—
(a) regulation 7(1), 7(2), 7(3) or 7(4);
(b) regulation 8(2);
(c) regulation 9(1), 9(2), 9(3) or 9(4);
(d) regulation 10;
(e) regulation 28(1) or 28(2);
(f) regulation 29(7) or 29(9);
(g) regulation 34(3) or 34(4);
(h) regulation 35(3) or 35(4).
(2) A specific act or omission shall attract only one such penalty if the circumstances are such that, but for this paragraph, it would attract more than one penalty.
