# The Air Navigation (Overseas Territories) Order 2013, Article 189A: Application of the Order to an aircraft the subject of an article 83 bis agreement


The provisions of this Order do not apply to an aircraft registered in the Territory where that aircraft is the subject of an agreement which is—
(a) made in accordance with article 83 bis of the Chicago Convention;
(b) registered with the Council of the International Civil Aviation Organization; and
(c) under which any of the Governor’s functions under this Order in respect of the aircraft have been transferred to the State of the operator.
