# The Arable Area Payments Regulations 1995, Regulation 6: Derogation from requirement to have farmed for two years land set aside


For the purposes of Article 3(4) of Commission Regulation 762/94, the special cases, where a farmer shall be entitled to claim set-aside compensatory payment on land which he has not farmed for the two years prior to the commencement of the set-aside period, shall be—
(a) in relation to land in England or Wales, those specified in Schedule 1, Part I; and
(b) in relation to land in Scotland, those specified in Schedule 1, Part II.
