# The Armed Forces Act 2006 (Transitional Provisions etc) Order 2009, Paragraph 49: Armed Forces Act 2001


In section 28(1) of AFA 2001 (costs), the reference to costs incurred as mentioned there by any of Her Majesty's forces includes costs incurred by any of Her Majesty's forces before commencement in respect of the exercise by a prosecuting authority of its functions as a party to proceedings under AA 1955, AFA 1955 or NDA 1957.
