# The Armed Forces and Reserve Forces (Compensation Scheme) Order 2011, Article 46: Date of claim

Extent: E+W+S+N.I.

(1) Subject to paragraph(3), the date on which a claim is made is the date on which it is received by the Service Personnel and Veterans Agency.

(3) Where article 45(1) applies, the date of claim is to be treated as—
(a) the day after the day on which the member is discharged on medical grounds; or
(b) the day after the date of death of the member.
