  "heading": "Eligibility for active membership",
  "text": "(1) A person is eligible to be an active member of this scheme if the person is in scheme employment under regulation 13 (descriptions of persons in scheme employment) on or after 1st April 2015 and the terms of the person’s employment do not exclude the person from being an active member of this scheme.\nThis is subject to paragraph (2).\n(2) A person is not eligible to be an active member of this scheme in relation to any scheme employment while the person—\n(a) is a member with full protection in a connected scheme in relation to that employment; or\n(b) is a member of another pension scheme in relation to that employment and the employer pays contributions to that scheme in respect of a member.\n(3) A person who is so eligible becomes an active member of this scheme on the person’s first day of service on or after 1st April 2015 in scheme employment (“the person’s first day”) unless—\n(a) the person exercises an option to the contrary under regulation 18; or\n(b) the person had opted out of pensionable service in a connected scheme in relation to that employment and that option had effect on the day before the person’s first day.\n(4) Where a remedy member—\n(a) is in Scheme employment on or after 1st April 2022, and\n(b) has made an election under section 5 of PSPJOA 2022 in relation to remediable service in a connected Scheme,\nthe member becomes an active member of this Scheme from their first day of service in Scheme employment on or after 1st April 2022.",
