  "heading": "Option for active members of Gurkha Pension Scheme to join the Scheme",
  "text": "(1) A person who—\n(a) would be eligible to join the Scheme by virtue of the person’s service in the Brigade of Gurkhas if the person met the condition in rule B.1(b)(i) (which requires that the person’s service begins on or after 6th April 2005),\n(b) meets the condition specified in paragraph (2), and\n(c) has opted to become an active member of the Scheme under the terms of this Part,\nis eligible to become such a member under those terms.\n(2) The condition referred to in paragraph (1)(b) is that the person has been an active member of the Gurkha Pension Scheme for a period beginning on or after 1st July 1997 and ending with 30 September 2007.\n(4) The option must have been exercised by giving notice in writing to the Scheme administrator in such form as the Secretary of State requires on or before 30th September 2007 or such later date as the Secretary of State considers appropriate.\n(5) For this purpose the notice is treated as having been given on the date on which it was received by the Scheme administrator.\n(6) The option has effect on 1st October 2007 and is irrevocable unless paragraph (7) applies.\n(7) This paragraph applies if the Secretary of State gives notice in writing to the person stating that the person may revoke the option by giving notice in writing of the revocation to the Secretary of State before the expiry of the period of 3 months beginning with the date on which the notice is given by the Secretary of State.\n(8) If a person revokes an option in accordance with paragraph (7), these Rules apply as if the person had never exercised the option.",
