  "heading": "Transfers out before 1st October 2023: AFPS 2015",
  "text": "(1) This paragraph applies where—\n(a) the Scheme manager for the reformed scheme paid a remediable transfer value in respect of a remedy member (“M”) before 1st October 2023, and\n(b) M’s remediable service is pensionable service under this Scheme by virtue of section 2(1) of PSPJOA 2022.\n(2) The remediable transfer value in sub-paragraph (1)(a)—\n(a) is not, and is treated as never having been, paid by the reformed scheme, and\n(b) is treated as being, and as always having been, paid by this Scheme.\n(3) In particular, paragraph (1) has effect—\n(a) for the purposes of determining which Scheme is (or at any time was) required to pay benefits to, or in respect of, the remediable transfer value in sub-paragraph (1)(a), and\n(b) for all other purposes.\n(4) Paragraph 43 applies to a remediable transfer value which is treated as paid from this Scheme under this paragraph.",
