Article 5

Where, but for the provisions of this Order, either no grant would be payable under section 1 of the Industry Act 1972 to a person towards approved capital expenditure incurred by that person or no such grant would be payable at the rate of 22 per cent, no grant or no grant at the said rate (as the case may be) shall be made to any person in respect of any such expenditure defrayed before the date on which this Order comes into operation.
