Regulation 8 Amendment of Annex 7 to Commission Regulation (EU) No 1178/2011

In Annex 7 (organisation requirements for aircrew (part-ORA)), in Subpart ATO (approved training organisations), in point ORA.ATO.135 (training aircraft and FSTDs), for point (a) substitute—

“(a)

Subject to (aa), the ATO must use an adequate fleet of training aircraft or FSTDs appropriately equipped for the training course provided. The fleet of aircraft must be composed of aircraft that comply with the requirements defined in Regulation (EU) 2018/1139.

(aa)

The ATO may provide training in an aircraft falling within point 1. (a), (b), (c), (d) or (g) of Annex I to Regulation (EU) 2018/1139, provided that the aircraft has been assessed by the head of training at the ATO as being suitable for the intended instruction, and:

(1)

holds a certificate of airworthiness issued in accordance with Annex 8 to the Chicago Convention;

(2)

is subject to a permission issued by the CAA in accordance with article 42(b) of the Air Navigation Order 2016; or

(3)

is an aeroplane or TMG used solely for non-commercial flight training of a registered owner or joint owner of the aircraft, a registered shareholder of a company that owns the aircraft, or the spouse or child of such a registered owner or joint owner.”.
