  "heading": "Interpretation of “bank”, “banker”, and “bankers’ books”.",
  "text": "(1) In this Act the expressions “ bank ”and “ banker ”mean—\n(a) a deposit-taker;\n(b) . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .\n(c) the National Savings Bank; . . .\n(d) . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .\n(1A) “Deposit taker” means—\n(a) a person who has permission under Part 4A of the Financial Services and Markets Act 2000 to accept deposits; or\n(b) an EEA firm of the kind mentioned in paragraph 5(b) of Schedule 3 to that Act which has permission under paragraph 15 of that Schedule (as a result of qualifying for authorisation under paragraph 12(1) of that Schedule) to accept deposits or other repayable funds from the public.\n(1B) But a person is not a deposit-taker if he has permission to accept deposits only for the purpose of carrying on another regulated activity in accordance with that permission.\n(1C) Subsections (1A) and (1B) must be read with—\n(a) section 22 of the Financial Services and Markets Act 2000;\n(b) any relevant order under that section; and\n(c) Schedule 2 to that Act.\n(2) Expressions in this Act relating to “ bankers’ books ”include ledgers, day books, cash books, account books and other records used in the ordinary business of the bank, whether those records are in written form or are kept on microfilm, magnetic tape or any other form of mechanical or electronic data retrieval mechanism.",
