Regulation 42 Amendments

At the end of regulation 3(2) of the Control of Pesticides Regulations 1986^f1 there shall be added the following sub-paragraph—

“(j)

any biocidal product—

(i)

authorised or registered under the 2001 Regulations,

(ii)

placed on the market for use in an experiment or test in accordance with regulation 16 of the 2001 Regulations, or

(iii)

the placing on the market and use of which are subject to any of the prohibitions specified in regulation 8 of the 2001 Regulations,

and in this sub-paragraph, “the 2001 Regulations” means the Biocidal Products Regulations 2001 and “biocidal product” shall have the meaning assigned to it in regulation 2(1) of the 2001 Regulations.”

In regulation 5(6) of the 1994 Regulations, after the words “the Food and Environment Protection Act 1985”, there shall be inserted the words “or a biocidal product which has been authorised or registered under the Biocidal Products Regulations 2001”.
