Where—

(a)

an application is made in accordance with paragraph 8;

(b)

the Ministers refuse to authorise or register the biocidal product, as the case may be; and

(c)

such refusal is upheld by a Commission decision,

the Ministers may grant a certificate of exemption in accordance with paragraph 15.
