In the case of the erection or extension of a building, the local authority are not satisfied that either—

(a)

any proposed drain or private sewer will be deemed to be a satisfactory drain by virtue of section 21(4) and (5) of the Act, or

(b)

in the particular case they may properly dispense with any provision for drainage.
