# The Bus Lanes (Approved Devices) (England) Order 2005, Article 3: Prescribed devices under section 20(9) of the Road Traffic Offenders Act 1988


A device falling within the description specified in article 2(a) is not an approved device unless—
(a) it is of a type approved by the Secretary of State under section 20(4)(a) of the Road Traffic Offenders Act 1988; and
(b) it is so used that any conditions subject to which the approval was given are satisfied.
