"text": "(This note is not part of the Regulations)\nSections 9 and 10 of the Care Act 2014 impose duties on a local authority to assess an adult’s needs for care and support, and a carer’s needs for support, by carrying out a needs assessment or a carer’s assessment. These Regulations make further provision about such assessments.\nThe Regulations also apply to an assessment carried out under that Act in relation to the likely care and support needs of a child on becoming an adult (a child’s needs assessment), the likely support needs of a young carer on becoming an adult (a young carer’s assessment) and the support needs of an adult carer of a child (a child’s carer’s assessment).\nRegulation 2 makes provision for supported self-assessment, where the individual to whom the assessment relates and the local authority carry out the assessment jointly. Regulation 3 makes provision about the manner in which assessments are carried out, and regulation 4 imposes requirements on local authorities relating to persons involved in the care of the individual whose needs are being assessed, including where it appears that any child is involved in providing care to any individual.\nRegulation 5 makes provision about the training and expertise of persons carrying out assessments, and regulation 6 makes specific provision about training and expertise in connection with the assessment of individuals who are deafblind. Regulation 7 requires the local authority to make a referral to the health service where it appears that the individual whose needs are being assessed may have a need for NHS Continuing Healthcare.\nA separate impact assessment has not been prepared for these Regulations. These Regulations are part of a package of legislative measures and the relevant impact assessment can be requested via careactconsultation@dh.gsi.gov.uk or Department of Health, Richmond House, 79 Whitehall, London SW1A 2NS and is available online at http://www.gov.uk/government/organisations/department-of-health.",
