Article 3 Request to Commission for determination of the body from which approval is required

(1)

If a Chapter or a fabric advisory committee wishes to have a determination by the Commission whether under section 6(1) an application for approval is required to be made to the fabric advisory committee or to the Commission then the request shall—

(a)

be made in writing in Form 1 in Schedule 2, and

(b)

be accompanied by plans, drawings, specifications or other documents adequately to illustrate the proposal or as may be requested by the Commission.

(2)

The question in the application in Form 1 shall be determined in writing by the Commission with reasons, either—

(a)

within 28 days from the date of receipt of the items supplied or requested under sub-rule (1)(b), or

(b)

within such period not exceeding 3 months as the Commission may reasonably require to determine the question, provided that prior written notice is given by the secretary of the Commission to the Chapter or fabric advisory committee, as the case may be, that the said period of 28 days is to be extended.
