Regulation 16 Amendments relating to the period within which a penalty notice must be issued

After regulation 3E (inserted by regulation 15 of these Regulations), insert—

“ Clandestine entrants: period within which a penalty notice must be issued

3F.

For the purposes of section 35(2)(e) of the Act, a penalty notice relating to a penalty under section 31A(1) or 32(2) of the Act must be issued before the end of 180 days beginning with the date on which the person became responsible for a clandestine entrant.”
