# The Charge Limitation (England) (Maximum Amount) (No. 2) Order 1990

## Introductory text

COMMUNITY CHARGE, ENGLAND AND WALES
Made 12th July 1990
Coming into force in accordance with article 1
Whereas the Secretary of State for the Environment, being of the opinion mentioned in subsection (1)(a) of section 100 of the Local Government Finance Act 1988in respect of each of the charging authorities listed in the Schedule to this Order, has pursuant to that section designated each such authority as regards the financial year beginning with 1st April 1990;
And whereas the Secretary of State has notified each of those authorities in writing pursuant to section 102(1) of that Act of his decision so to designate it, the principles determined under section 100(4) of that Act in relation to it, and the amount which he proposed should be the maximum for the amount calculated by it in relation to that year under section 95(4) of that Act;
And whereas the period mentioned in section 102(5) of that Act has ended without any of those authorities informing the Secretary of State by notice in writing under section 102(5)(a) or (b) of that Act;
And whereas a draft of this Order has been laid before and approved by resolution of the House of Commons;
Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 106(2) and (5) of the Local Government Finance Act 1988 and of all other powers enabling him in that behalf, hereby makes the following Order:

## 1 Title and commencement

This Order may be cited as the Charge Limitation (England) (Maximum Amount) (No. 2) Order 1990 and shall come into force on the day after the day on which it is made.

## 2 Interpretation

In this Order “the Act” means the Local Government Finance Act 1988.

## 3 Maximum amounts

The amount which the amount calculated by an authority shown in the Schedule to this Order in relation to the year beginning with 1st April 1990 under section 95(4) of the Act is not to exceed is the amount shown against the name of the authority in that Schedule, which amount is the amount stated in the notice to the authority under section 102(1)(c) of the Act.
