Explanatory note

Regulation 2 amends regulation 10(7) of the Childcare (Fees) Regulations 2008 (S.I. 2008/1804) (“the 2008 Regulations”) to extend to 31st August 2012 the transitional provision for those childcare providers (other than childminders) who were automatically transferred on 1st September 2008 from the childcare register under Part 10A of the Children Act 1989^f1 to the early years register under the Childcare Act 2006. The transitional provision means that for such providers the fee applicable to early years provision that is provided for more than 3 hours per day but less than 4 hours per day will continue to be £50 (rather than £220 as would otherwise be the case under regulation 10(3) of the 2008 Regulations).

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. The impact on the public sector is minimal.
