# The Community Care Plans (Disapplication) (England) Order 2003, Article 2: Disapplication


The following provisions shall not apply to local authorities to which this Order applies—
(a) subsections (1) and (2) of section 46 of the Act; and
(b) the entry relating to section 46 of the Act contained in Schedule 1 to the Local Authority Social Services Act 1970.
