Where the Director gives guidance, he shall do so in writing to the applicant, stating the facts on which he bases the guidance and his reasons for it.

(2)

Where the Director determines an application for guidance by exercising his discretion not to give guidance, he shall give written notice to the applicant of that fact and shall repay the whole of the fee in accordance with rule 6(6)(b) above.
