(1)

On an application under section 14 for an agreement to be examined:

(a)

if the Director proposes to grant an individual exemption, whether or not subject to conditions or obligations, he shall consult the public; and

(b)

if the Director proposes to make a decision that the Chapter I prohibition has not been infringed, he may consult the public.

(2)

If, on an application under section 22 for conduct to be considered, the Director proposes to make a decision that the Chapter II prohibition has not been infringed, he may consult the public.
