# The Concession Contracts (Scotland) Regulations 2016, Regulation 18: Exclusion of activities which are directly exposed to competition

These Regulations do not apply to the procurement for the award of a concession contract by a utility if the contract is intended to enable an activity referred to in regulation 32 (activities directly exposed to competition) of the Utilities Contracts (Scotland) Regulations 2016 to be carried out and that activity is or is established to be directly exposed to competition in accordance with that regulation.
