  "heading": "Provision of audit report to the Secretary of State",
  "text": "(1) Subject to regulation 40(1), as soon as practicable after the audit report is received, the delivery body must give a notice to the Secretary of State which—\n(a) includes the audit report; and\n(b) only where a report is obtained under regulation 36(1)(b), having regard to that report, states whether the delivery body intends—\n(i) to proceed in accordance with Part 6 and, if so, the date on which it intends to do so (“a proceed notice”); or\n(ii) to re-run the contract allocation process or any part of it as set out in the notice and, if so, the date on which it intends to commence the re-run (“a re-run notice”).\n(2) A date under paragraph (1)(b) must be not be earlier than 2 working days after the date of the notice.",
