Article 5 Automatic directions

For Order 8, rule 2(4), there shall be substituted the following new paragraph–

“(4)

Where an originating process in a fixed date action to which Order 17, rule 11 does not apply is to be served out of England and Wales under paragraph (2) the court shall fix the return day having regard to the distance of the country of service.”.
