Article 18 Miscellaneous amendments

For Order 9, rule 2(8) there shall be substituted the following—

“(8)

In an action for a liquidated sum, the proceedings shall be automatically transferred to the defendant’s home court if the action was not commenced in that court—

(a)

except where sub-paragraph (b) applies, on the filing of a defence, or

(b)

in a case to which paragraph (7)(b) applies, where the plaintiff confirms in writing under that paragraph that he wishes the proceedings to continue.”.
