Article 3 Possession Procedure

After Order 3, rule 3(1A), there shall be inserted the following new paragraph—

“(1B)

Without prejudice to paragraph (1A), the summons in an action for recovery of land, including one in which the mortgagee under a mortgage of land claims possession of the mortgaged land, shall be prepared by the plaintiff and in that event the summons with a copy for each defendant shall be filed by the plaintiff with the documents mentioned in paragraph (1) and, where service is to be effected otherwise than by an officer of the court, a copy of the summons shall be filed for the court instead of a request.”.
