"text": "(This note is not part of the Rules)\nThese Rules consolidate with minor consequential amendments, the County Court Rules (Northern Ireland) 1976, the County Court (Rent Order) Rules (Northern Ireland) 1978, the County Court (Licensing) Rules (Northern Ireland) 1979 and the County Court (Adoption) Rules (Northern Ireland) 1980 and the amendments to those Rules in force on 5th June 1981.\nThe Rules also make the following new provisions and amendments:—\n1. A matter adjourned generally may be struck out if no application for a hearing has been made in the preceding year (Order 14, Rule 4(4)).\n2. Provision is made for entering a defence to a remitted action (Order 22, Rule 8(5)).\n3. Rule 19 of Order 25 (which requires proceedings heard before a [ district judge] to be treated as if heard before a Judge) has been amended to exclude the provisions of Rule 19(1)(a) of Order 55 (half costs if amount awarded by Judge does not exceed £500).\n4. The time for service of a summons under section 17 of the Married Women’s Property Act 1882 has been increased from 16 to 28 days before entry day (Order 29, Rule 1(1)).\nIndex\nUnless otherwise indicated, a reference to an Article is to that Article as numbered in the County Courts (Northern Ireland) Order 1980 and a reference to an Order or rule is to that Order or rule as numbered in the County Court Rules (Northern Ireland) 1981.\nABANDONMENT,\naction, of,\nO.21 r.1\nclaim, of part of,\nO.9 r.4\nwhere account taken,\nO.9 r.6\nexcess, of\nArt, 10(1)(c); O.5 r.2(6); O.9 r.6\ntime for,\nO.9 4.r.4\nABROAD,\nservice, at suit of the Crown,\nO.6 r.11 (2)–(3)\nwitnesses, examination of\nArt. 43\nACCEPTANCE,\npayment into court, of,\nO.21 r. 3\nnotice of,\nO.21 rr.3, 4, 6\nACCOUNTANT GENERAL,\ninvestment (of moneys paid into court) in name of,\nO.45 r. 2\nsale of land, in relation to,\nO.33 r.16; O.34 r.10(2)\nsecurity, deposit of money as, concerning,\nO.42 r. 2\nACCOUNTS,\ncounty court funds, of,\nO.45 r.1\ndirections for,\nO.17 r.6\nequity proceedings, in,\nO.17 rr.4–6; O.17 r.13\n(see also EQUITY PROCEEDINGS)\nlodged with chief clerk, form of,\nO.43 r.18\nnotice to parties to attend upon taking of,\nO.17 r.6(1)\nprimary decree for,\nO.17 r.4\nreceiver’s,\nO.18 r.4\nreview of,\nO.18 r.7\ntime for passing, notice of,\nO.18 r.5\nreference of, to officer,\nArt. 31(1)(b); O.17 rr.1–3\nresult of, certificate of,\nO.18 r.6\ntaking of (before hearing), application for,\nO.14 r.6\nACTION OR MATTER,\nabandonment of,\nO.21 r. 1\naction, meaning of,\nArt. 2(2)\nnotice of change of party’s title,\nO.3 r.23\nrepresentative,\nO.3 r.7\nadjournment of, court’s power of,\nArt. 8; O.14 r.4\ndeposit of fee for assessor,\nO.19 r.6\ngeneral, notice after\nO.14 r.4(3)\nnotice of, form of,\nO.14 r.4(2) (See also O.14 r.4(4))\nstriking out of action after,\nO.14 r.4(4)\nadministration of estates.
