  "heading": "Regulations made by the Scottish Ministers, the Department of Justice or the Welsh Ministers",
  "text": "(1) The following regulations (which are made by the Scottish Ministers) are subject to the affirmative procedure—\n(a) regulations under section 67(2);\n(b) regulations under section 251(3) that amend primary legislation;\n(c) regulations under paragraph 10(4) of Schedule 7.\n(2) Any other regulations made by the Scottish Ministers under this Act are subject to the negative procedure.\n(3) For the meaning of “affirmative procedure” and “negative procedure”, see Part 2 of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10).\n(4) A power of the Department of Justice in Northern Ireland to make regulations under this Act is exercisable by statutory rule for the purposes of the Statutory Rules (Northern Ireland) Order 1979 (S.I. 1979/1573 (N.I. 12)).\n(5) The following regulations may not be made unless a draft of the regulations has been laid before and approved by a resolution of the Northern Ireland Assembly—\n(a) regulations under section 67(3);\n(b) regulations under section 251(4) that amend primary legislation;\n(c) regulations under paragraph 10(6) of Schedule 8.\n(6) Any other regulations made by the Department of Justice in Northern Ireland under this Act are subject to negative resolution within the meaning given by section 41(6) of the Interpretation Act (Northern Ireland) 1954.\n(7) Regulations of the Welsh Ministers under this Act are to be made by Welsh statutory instrument.\n(8) Regulations made by the Welsh Ministers under section 243 are subject to the Senedd annulment procedure (see section 37E of the Legislation (Wales) Act 2019 (anaw 4)).\n(9) In this section—\n“primary legislation” has the meaning given by section 252;\n“regulations” means regulations under any provision of this Act except section 255.",
