  "heading": "Orders and rules",
  "text": "(1) This section applies to—\n(a) any power conferred by this Act on the Secretary of State to make an order or rules;\n(b) the power conferred by section 168 . . . or the Lord Chief Justice to make an order.\n(c) the powers conferred on the Lord Chancellor by sections 29(2E), 174(4) and 269(6) to make an order.\n(2) The power is exercisable by statutory instrument.\n(2A) Where a statutory instrument is made by the Lord Chief Justice in the exercise of the power referred to in subsection (1)(b), the Statutory Instruments Act 1946 applies to the instrument as if it contained an order made by a Minister of the Crown.\n(3) The power—\n(a) may be exercised so as to make different provision for different purposes or different areas, and\n(b) may be exercised either for all the purposes to which the power extends, or for those purposes subject to specified exceptions, or only for specified purposes.\n(4) The power includes power to make—\n(a) any supplementary, incidental or consequential provision, and\n(b) any transitory, transitional or saving provision,\nwhich the Minister making the instrument considers necessary or expedient.\n(5) A statutory instrument containing—\n(a) an order under any of the following provisions—\nsection 22(3C),\nsection 25(5),\nsection 103,\n. . .\n...\n...\n...\nsection ...\nsection ...\n...\nsection 237A(13),\nsection 246(5),\nsection 254(6A),\nsection 255A(10),\nsection 255BA(10),\nsection 256AZB,\n...\nsection 258(2C),\nsection 260,\nsection 267,\n...\nsection 281(2),\nsection 283(1),\nsection 291,\nsection 301(5),\nsection 325(7), and\n...\nparagraph 5 of Schedule 31,\n(aa) an order under section 23A(4) which makes provision—\n(i) increasing the fraction in section 23A(3)(a), or\n(ii) increasing the figure in section 23A(3)(b) by more than is necessary to reflect changes in the value of money,\n(b) . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . or\n(c) an order making any provision by virtue of section 333(2)(b) which adds to, replaces or omits any part of the text of an Act, ...\n(d) . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .\nmay only be made if a draft of the statutory instrument has been laid before, and approved by a resolution of, each House of Parliament.\n(6) Any other statutory instrument made in the exercise of a power to which this section applies is subject to annulment in pursuance of a resolution of either House of Parliament.\n(7) Subsection (6) does not apply to a statutory instrument containing only an order made under one or more of the following provisions—\n...\n...\nsection 253(5),\nsection 325(6)(i), and\nsection 336.",
