# The Capital Requirements (Amendment) (EU Exit) Regulations 2018, Regulation 98: Article 84 (minority interests included in consolidated Common Equity Tier 1 capital)


(1) Article 84 (minority interests included in consolidated Common Equity Tier 1 capital) is amended as follows.
(2) In paragraph 1(a), in points (i) and (ii)—
(a) for “Article 104 of Directive 2013/36/EU” in both places it occurs substitute “regulation 34 of the Capital Requirements Regulations 2013”;
(b) for “point (6) of Article 128 of Directive 2013/36/EU” in both places it occurs substitute “regulation 2 of the Capital Requirements (Capital Buffers and Macro-prudential Measures) Regulations 2014”.
(3) In paragraph 5, in point (c), for “by virtue of the control relationship defined in Article 1 of Directive 83/349/EEC” substitute “and which is a subsidiary because of section 1162 of the Companies Act 2006”.
(4) Omit paragraph 6.
