Regulation 23 Effect on maintenance calculation—special expenses
Subject to paragraph (2) and regulations 26 and 27, where the variation agreed to is one falling within regulation 10 to 14 (special expenses) effect shall be given to the variation in the maintenance calculation by deducting from the net weekly income of the non-resident parent the weekly amount of those expenses.
Where the income which is taken into account in the maintenance calculation is the capped amount and the variation agreed to is one falling within regulation 10 to 14 then—
the weekly amount of the expenses shall first be deducted from the actual net weekly income of the non-resident parent;
the amount by the which the capped amount exceeds the figure calculated under sub-paragraph (a) shall be calculated; and
effect shall be given to the variation in the maintenance calculation by deducting from the capped amount the amount calculated under sub-paragraph (b).
