# The Coasting Schools (England) Regulations 2016, Regulation 3: Disapplication of coasting schools regime for certain descriptions of school and Academy


(1) Section 60B of the Education and Inspections Act 2006 does not apply to—
(a) a community or foundation special school; or
(b) a maintained nursery school.
(2) Section 2B of the Academies Act 2010 does not apply to—
(a) an Academy school specially organised to make special educational provision for pupils with special educational needs; or
(b) an alternative provision Academy.
