Regulation 12 Amendment to Part 11 - planning obligations
In regulation 122(3) (limitation on use of planning obligations), in the definition of “relevant determination”—
after “section 70,” insert “73,”;
omit—
“which is not an application to which section 73 of TCPA 1990 applies”, and
“where the application which gives rise to the appeal is not one to which section 73 of TCPA 1990 applies”.
In regulation 123(3) (further limitation on use of planning obligations), for “before the date that obligation A was entered into” substitute “on or after 6th April 2010”.
In regulation 123(4), in the definition of “determination”—
after “section 70,” insert “73,”;
omit—
“which is not an application to which section 73 of TCPA 1990 applies”, and
“where the application which gives rise to the appeal is not one to which section 73 of TCPA 1990 applies”.
