Regulation 27 Effect of correction of a charging schedule
Paragraph (3) applies where—
the error corrected is one to which regulation 26(2)(b) applies; and
as a result of the error, the chargeable amount payable in respect of a chargeable development (D) decreases.
The collecting authority must—
notify the affected persons in writing of the correction; and
recalculate—
the chargeable amount payable in respect of D, and
where relief has been granted in respect of D, the amount of relief granted.
For the purposes of paragraph (3)(a) the affected persons are—
where D has been commenced, the persons liable to pay CIL in respect of D;
where D has not commenced, the persons on whom the collecting authority is required to serve a liability notice in respect of Df1.
For the purposes of paragraph (3)(b), the amount of any relief must be recalculated by reference to the corrected charging schedule, but must otherwise be calculated on the same basis as when originally calculated and using the information available to the collecting authority at that time.
