  "text": "This draft supersedes the draft laid on 24th February 2005 and is being issued free of charge to all known recipients of the earlier draft.\nDraft Order laid before Parliament under section 46(8) of the Companies Act 1989, for approval by resolution of each House of Parliament.\ncompanies\nMade 2005\nComing into force in accordance with article 1\nWhereas it appears to the Secretary of State that the Professional Oversight Board for Accountancy is willing and able to exercise the functions transferred by this Order;\nWhereas it appears to the Secretary of State that the Professional Oversight Board for Accountancy has arrangements in place relating to the exercise of those functions which are such as to be likely to ensure that the functions in question will be exercised effectively and to ensure that the functions will be exercised in accordance with the requirements specified in this Order;\nWhereas the Secretary of State laid the draft of this Order before Parliament and the draft was approved by a resolution of each House of Parliament;\nNow, therefore, the Secretary of State in exercise of the powers conferred upon him by sections 46(1) and (2) and 46A(4) of, and paragraph 11(3)(a),(d) and (e) of Schedule 13 to, the Companies Act 1989 hereby makes the following Order:",

Section 46 was amended by paragraph 2(2) of Schedule 2 to The Competition Act 1998 and Other Enactments (Amendment) Regulations 2004 (S.I. 2004/1261) and by section 3 of the Companies (Audit, Investigations and Community Enterprise) Act 2004 c.27. Section 46A was inserted by section 4 of that Act. Paragraph 11 of Schedule 13 was amended by section 5(4) of that Act."
