Regulation 13 Failure of a consumer to return returnable goods
This regulation applies where a consumer is responsible for returning returnable goods (supplied by means of sale in exchange for one or more relevant payments) under regulation 12(2) and fails to return any of those goods to the trader.
The consumer’s liability for relevant paymentsf1 is extinguished by (T − C), where—
“T” is the total amount of those payments, and
“C” is the amount of those payments that the consumer is liable to pay under the subscription contract in exchange for the returnable goods mentioned in paragraph (1), which have not been returned.
If the consumer has made any relevant payments to the trader which in total exceed the amount of C, the trader must refund those payments less that amount to the consumer.
