Regulation 21 Payments of refunds
This regulation applies where as a consequence of regulation 11 a consumer is entitled to receive a refund from the trader of one or more relevant payments made by the consumer to the trader under a contract which has been cancelled.
The trader must make that refund to the consumer—
without undue delay, and
in any event before the end of the payment period.
The payment period is the period of 14 days beginning with—
if the consumer is responsible for returning returnable goods supplied by means of sale to the trader under regulation 12(2)—
the day after the day on which the trader receives the returnable goods back, or
if earlier, the day after the day on which the consumer supplies evidence of having sent the goods back to the trader;
in any other case, the day after the day on which the contract was cancelled under section 264 of the DMCCA (right to cancel during cooling-off periods).
The trader must make the refund using the same means of payment as the consumer used to make the relevant payment to which it relates, unless the consumer expressly agrees otherwise.
