  "heading": "Amendments to paragraphs 3 and 4 of Schedule 22 to the DMCCA: medical prescriptions etc",
  "text": "(1) In Schedule 22 to the DMCCA, in paragraph 3 (excluded contracts where the supply is made for purposes relating to health)—\n(a) in sub-paragraph (1)(a) omit “and”;\n(b) in sub-paragraph (1)(b)(ii) for “.” substitute “, and”;\n(c) after sub-paragraph (1)(b)(ii) insert—\n“(c) is not of an optical appliance.”;\n(d) in sub-paragraph (2) in the appropriate place insert—\n““optical appliance” has the meaning given by section 36(1) of the Opticians Act 1989;”\n(e) in sub-paragraph (2), in paragraph (c) of the definition of “prescriber”, for “but as if that definition included “a dentist”;” substitute—\n“but as if—\n(i) that definition included “a dentist”, and\n(ii) in paragraph (i) of that definition, “under an agreed clinical management plan” were omitted;”\n(2) In Schedule 22 to the DMCCA, in paragraph 4(2) (definitions for the purposes of excluded contracts for supplies by a health care professional or a person included in a relevant list etc) in the definition of “relevant list” after paragraph (c)(iv) (in relation to arrangements in Scotland; the dental list), insert—\n“(v) the Ophthalmic List prepared under regulation 6 of the National Health Service (General Ophthalmic Services) (Scotland) Regulations 2006 (S.S.I. 2006/135);”.",
