Section 39A was inserted by the Mental Health Act 2007 (c.12) (“the 2007 Act”), Schedule 9, paragraphs 1 and 6. Paragraph 182 of Schedule A1 to Mental Capacity Act 2005 (as inserted by section 50(5) of, and Schedule 7 to, the 2007 Act) provides for a local authority to be a supervisory body.
