  "heading": "Failures in respect of footprint reports",
  "text": "(1) The penalties in paragraph (2) apply where a participant—\n(a) fails to provide a footprint report contrary to article 39(1); or\n(b) provides late a footprint report contrary to article 39(2).\n(2) The penalties are—\n(a) a financial penalty of £5000 and publication; and\n(b) where the report is provided—\n(i) no more than 40 days after the due date, a financial penalty of £500 for each day the report is provided after the due date; or\n(ii) more than 40 days after the due date or not at all, a financial penalty of £40,000.",
