  "text": "(1) Where the Agency proposes to impose a variable monetary penalty on a person, the Agency must serve on that person a notice of its intention to do so (a “notice of intent”).\n(2) A notice of intent must include—\n(a) the grounds for imposing the variable monetary penalty;\n(b) the amount of the penalty;\n(c) information as to—\n(i) the right to make representations and objections within a period of 28 days beginning with the day on which the notice of intent is received (“the 28 day period”);\n(ii) the circumstances in which the Agency may not impose the penalty.",
