Draft Order laid before the Scottish Parliament under section 15(3)(b) of the Dog Fouling (Scotland) Act 2003, for approval by resolution of the Scottish Parliament.

The Scottish Ministers make the following Order in exercise of the powers conferred on them by sections 9(2) and 15(2)(b) of the Dog Fouling (Scotland) Act 2003 and all other powers enabling them to do so.
In accordance with section 15(3)(b) of that Act a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

## 1 Citation and commencement

This Order may be cited as the Dog Fouling (Fixed Penalty) (Scotland) Order 2016 and comes into force on 1st April 2016.

## 2 Amount of fixed penalty for dog fouling

For the purposes of section 9 of the Dog Fouling (Scotland) Act 2003 (amount of fixed penalty), the percentage prescribed for the fixed penalty is 40 per cent of level 1 on the standard scale.

## 3 Application

Article 2 applies to fixed penalty notices issued under section 5 of the Dog Fouling (Scotland) Act 2003 on or after 1st April 2016.

The new amount will only apply to fixed penalties issued on or after 1st April 2016.
