Paragraph 12 Notice of intent
Subject to sub-paragraph (3), where the enforcement authority proposes to impose a civil sanction on a person, it must serve on that person a notice of what is proposed (a “notice of intent”).
The notice of intent must include—
the grounds for the proposed civil sanction;
the requirements of the notice and, in the case of a civil penalty, the amount to be paid; and
information as to the right to make representations and objections within 28 days beginning with the day on which the notice of intent was received.
The requirement to serve a notice of intent does not apply where—
the proposed civil sanction is a compliance notice; and
the enforcement authority reasonably considers that, in consequence of one or both of the matters referred to in sub-paragraph (4), it is appropriate to serve a final notice pursuant to paragraph 14(5) without first serving a notice of intent.
The matters referred to in paragraph (3) are–
a risk of harm to, or disruption of, the electricity system;
a risk to public health or safety.
