after paragraph (4), insert—

“(5)

Where SEPA treats an activity in accordance with paragraph (1), the person or persons it considers to be in control of the carrying on of the activity are to be treated for the purposes of these Regulations as—

(a)

in relation to treatment as a notification, the person who makes a notification in accordance with regulation 12(3),

(b)

in relation to treatment as a permit or registration, the applicant.”.
